These Terms and Conditions comprise a binding contract between you as an authorised user of the SpectrumPhotos Online service and SpectrumPhotos for the purchase of photographic prints, greetings cards and photo gifts uploaded via the Internet or sent to us on a CD. By submitting an order, you agree to be bound by these Terms and Conditions. SpectrumPhotos will not be responsible for any loss or damage howsoever arising as a result of a failure on the part of SpectrumPhotos to fulfil an order. The offer and description of this service by SpectrumPhotos does not of itself represent an agreement to accept an order in accordance with these Terms and Conditions.

Delivery Of Prints

All prints will be delivered to the delivery address supplied by you during the registration process. Your order will be accepted upon submission by you of an offer to buy prints, greetings cards and photo gifts using the appropriate order facility and upon SpectrumPhotos notifying you by e-mail that your order has been accepted and has agreed to supply the prints, greetings cards and photo gifts to you.

Time for delivery is a best estimate and SpectrumPhotos shall not be liable for any loss or damage arising as a result of late delivery of the prints.

Orders may be refused without explanation and entirely at the discretion of SpectrumPhotos.

Price/Specification

All orders to be shipped within the European Union include UK Value Added Tax at the appropriate rate (currently 17.5%). Postage and packaging where appropriate will be listed separately. SpectrumPhotos shall not be liable for any other taxes or duties that may be imposed upon you and for which you will remain fully responsible.

Prices and specifications are subject to change without notice in any circumstances other than where an order has been accepted by SpectrumPhotos.

The purchase price is payable in advance by credit/debit card. We reserve the right to refer to your credit/debit card provider and any other credit reference agency or bank.

Returns

In the event that you are unhappy with any aspect of our Online Print service, we will not accept any returned prints and not issue any refunds since they have been processed and printed in our laboratory. However with regards to our Mirrors, we will offer a 28 day money back guarantee, where you must return the mirror to us in exactly the same condition it was received and must pay for the cost of the single carriage back to us. Additionally, due to the personalised nature of photo gifts and greetings cards, we are unable to offer refunds on these items. Statutory rights not affected.

SpectrumPhotos will use all reasonable endeavours to prevent any breaches of security including credit/debit card details provided by you and further to use all reasonable endeavours to ensure that any SpectrumPhotos supplier/sub-contractor or agent exercises the same standard of care similarly to prevent breaches of confidence.

SpectrumPhotos reserves the right without notice to suspend or alter the operation of its services at its sole discretion and without reason. In such circumstances notice will be provided wherever possible.

It is understood that you are solely responsible for the security and use of any user names and passwords needed to access the service or any part of it.

You warrant and undertake that you are at least 18 years of age and the authorised owner of the credit/debit card details which you supply to SpectrumPhotos.

You warrant that you will not use the service for any fraudulent or illegal purpose, for the transmission or posting of computer viruses or any material which is defamatory, offensive or obscene, and you accept and undertake that you will be liable for any action taken against SpectrumPhotos in relation to such use and will fully indemnify SpectrumPhotos against all actions, claims, demands or costs which may arise as a result.

You agree and undertake with SpectrumPhotos that you are the owner of the copyright in any material that you send to us for reproduction.

SpectrumPhotos's liability to you shall be limited to the sum of £50 for any one incident or series of related incidents and up to a total of £100 for all incidents in any period of twelve months.

SpectrumPhotos shall not be liable for any economic loss, profits or anticipated savings, any loss of goodwill and reputation or any loss of data or any consequential loss as a result of breach of contract and/or negligence.

Nothing in these Terms and Conditions shall confer on any third party any benefit or right to enforce any term of this Agreement. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these purchase terms.

These Terms and Conditions form the entire agreement between you and SpectrumPhotos and supersede any oral or written communication agreements or other representations. SpectrumPhotos reserves the right to add or change these Terms and Conditions at its sole discretion at any time without prior notice.

These Terms and Conditions are governed by the laws of England and are subject to the exclusive jurisdiction of the English Courts.
